Analysis of the legal protection action of workers dismissed due to problems in their employment relationship

The study focuses on the legal protection and remedies available to workers who experience termination of their employment relationship due to a change in their contract status. This research adopts a normative legal approach to examine the legal situation. The results indicate that any change in employment status can only be made if both parties agree to rehire the worker. The lack of an agreement to rehire is considered a tort. As a consequence, the affected worker can initiate a legal process based on tort that could lead to termination of the employment relationship. In summary, the main conclusion is that termination of the employment relationship without a contractual agreement due to a change in status constitutes a tort. The affected employees are entitled to claim compensation for this tort under the relevant legal provisions.
