The Legal Framework of Family Violence in Ecuador: Analysis and Effectiveness

Family violence in Ecuador represents a significant challenge that affects thousands of people, mainly women. This review article analyzes the Ecuadorian legal framework on family violence, evaluating its historical evolution, its current effectiveness and the challenges in its implementation. Since the promulgation of the Law Against Violence against Women and the Family in 1995 to the reforms of the Penal Code in 2014, Ecuador has made important legislative advances. However, despite these reforms, family violence remains prevalent and the effectiveness of the legal system is limited by problems in enforcement and insufficient resources. Statistical analysis reveals an increase in complaints, which may reflect greater confidence in the system, but also highlights a high incidence of family violence. Case studies and interviews highlight the difficulties victims face in accessing justice, including revictimization and delays in issuing protective measures. The evaluation of public policies shows that, although there are promising prevention and victim support programs, their effectiveness varies significantly between regions.
This article proposes to strengthen the training of judicial officials, improve inter-institutional coordination and continue awareness campaigns to change cultural attitudes towards family violence.
