Necessary Reforms in Criminal Law to Combat Family Violence in Ecuador

Abstract

Ecuador has made important legislative advances in its fight against family violence, particularly with the implementation of the Comprehensive Organic Penal Code (COIP) in 2014 and the Comprehensive Organic Law to Prevent and Eradicate Violence against Women in 2018. However, significant deficiencies in the application and effectiveness of these laws. Problems such as inconsistency in the definition of family violence, inadequate protection for victims, lack of a gender perspective, and long and complex judicial processes continue to hinder effective protection of victims. Several necessary reforms are identified, including clarifying and expanding the definition of family violence, strengthening protective measures, incorporating a gender perspective, and simplifying judicial procedures. Successful models from other countries, such as Spain and Canada, offer valuable lessons that can be adapted to the Ecuadorian context to improve the response to family violence. Implementing these reforms will require political commitment and adequate resources, as well as inter-institutional collaboration and public awareness to overcome cultural and social resistance.
